Contract
The Buyer has the right to withdraw from the Contract within 14 days of receiving the delivery. Within this period, he must inform the company unambiguously that he is withdrawing from the contract by sending an email to the contact email address (info@genusluxuries.com), without having to give a reason for their decision. The withdrawal form is available here. The only cost to be borne by the consumer in connection with withdrawal from the contract is the cost of returning the goods (Article 43d, paragraph 7). The goods must be returned to the provider no later than 14 days from the date on which the withdrawal (purchase) was communicated to Genus Luxuries Ltd., Kidričeva ulica 19, 5000 Nova Gorica.
Consumer (buyer) does not have the right of withdrawal from the contract (referred to in Article 43(1)(c)) for goods that are made according to his/her precise instructions and are tailored to his/her personal needs. In practice, this means that for all products made to the consumer’s wishes, the consumer does not return the product, but is obliged to pay according to the contract. The supplier is not liable for incorrectly selected personalisation options (e.g. colour, size, misspellings, etc.) at the time of purchase.
Refunds
Returned goods must be undamaged, in the same quantity, and in the same packaging. In addition to the returned product, the buyer should enclose a copy of the invoice and its transaction account number. The refund will be made as soon as possible or at the latest within 14 days of receipt of the cancellation notice. The Provider shall return the payments received from the Buyer in the same amount in the same way as the payment was received (by the same means of payment), unless the consumer has expressly requested the use of another means of payment and if the consumer does not bear any costs as a result.
Guarantee
The guarantee applies to items for which this is stated on the guarantee certificate or invoice. The guarantee shall be valid subject to compliance with the instructions on the guarantee certificate and the presentation of the invoice. The warranty periods are as follows indicated on the warranty card or on the invoice. Information on the guarantee is also given in the description of the product.
Substantive errors
The error is factual:
– when a thing lacks the characteristics necessary for its normal use or for circulation;
– if the thing does not have the characteristics necessary for the particular use for which the buyer is buying it, which was known or ought to have been known to the seller;
– if the thing does not possess the qualities and characteristics which were expressly or tacitly agreed or prescribed;
– if the seller has handed over an item which does not correspond to a sample or model, unless the sample or model was shown for information purposes only.
The supplier shall be liable for material defects in the goods which become apparent within two years of receipt of the goods.
The consumer may exercise his/her rights under the material defect if he/she notifies the supplier of the defect within two months of the date on which the defect was discovered. In the notification of the defect, the consumer must describe the defect in more detail and give the seller the opportunity to inspect the item. The consumer may notify the seller of the defect in person or by sending it to the shop where the goods were bought or to the seller’s agent with whom the consumer has concluded a contract. The provider shall not be liable for material defects in the goods which become apparent after two years since the goods were delivered. A defect in the goods shall be deemed to have existed at the time of delivery if it appears within six months of the delivery.
A consumer who has duly informed the seller of a defect has the right to require the seller to:
– remedy the defect in the goods; or
– refund a proportion of the amount paid in proportion to the defect; or
– replace the defective goods with new, faultless goods; or
– refund the amount paid.
The supplier will reply in writing to the consumer no later than eight days after receipt of the request. The right to claim a material defect in the goods is governed in more detail by the provisions of the Consumer Protection Act.
